3. ORIGINAL ARTWORK

Original artwork displayed or sold through The ArtGraTech remains protected by applicable intellectual-property law.

Purchase of an original physical artwork transfers ownership of the physical artwork only, unless otherwise expressly agreed in writing.

Purchasing an original artwork does not automatically transfer:

  • copyright;

  • reproduction rights;

  • licensing rights;

  • merchandising rights;

  • commercial-use rights;

  • digital reproduction rights; or

  • the right to create derivative works.

The ArtGraTech retains intellectual-property rights in original artwork to the extent provided by applicable law and the applicable Terms & Conditions.

4. ART PRINTS & REPRODUCTIONS

Purchasing an authorized art print provides ownership of the physical copy purchased.

It does not grant permission to:

  • reproduce the artwork;

  • scan the artwork for commercial use;

  • create additional prints;

  • place the artwork on merchandise;

  • sell digital reproductions;

  • create commercial derivative works; or

  • otherwise commercially exploit the underlying artwork.

Unauthorized reproduction or commercial use is prohibited.

5. CREATIVE STUDIO WORK

Intellectual-property ownership and usage rights relating to:

  • logos;

  • visual identities;

  • branding;

  • digital designs;

  • campaign assets;

  • merchandise designs;

  • commissioned graphics;

  • custom artwork; and

  • other Creative Studio services

are determined by the applicable Terms & Conditions, project description, invoice, proposal, license, or written project agreement.

Payment for creative services does not automatically transfer every intellectual-property right, editable working file, unused concept, or preliminary design unless expressly included in the applicable agreement.

6. TRADEMARKS & BRAND IDENTIFIERS

The ArtGraTech, its logos, visual identifiers, signature graphics, slogans, design elements, and associated branding may constitute trademarks, service marks, trade dress, copyrighted works, or other proprietary brand assets of A Marshall Concepts LLC.

Nothing on the Site grants any license or right to use these brand assets without prior written permission.

You may not use ArtGraTech branding in a way that falsely suggests:

  • affiliation;

  • endorsement;

  • sponsorship;

  • partnership;

  • authorization; or

  • association with The ArtGraTech.

No use of the ® symbol is intended unless the applicable mark has been federally registered and is entitled to that designation.

7. PERMITTED PERSONAL USE

Visitors may view and access publicly available Site content for ordinary personal and informational purposes.

Reasonable sharing of a publicly available Site page through a direct website link or available social-sharing feature is permitted.

This limited permission does not authorize:

  • commercial reproduction;

  • resale;

  • redistribution of downloadable artwork;

  • creation of unauthorized merchandise;

  • use of artwork in another brand;

  • representation of ArtGraTech work as another person's work.

8. PORTFOLIO & CLIENT WORK

Certain work displayed on the Site may have been created for clients or in collaboration with other parties.

Third-party names, trademarks, logos, photographs, or other materials appearing within portfolio work remain the property of their respective owners where applicable.

Display of client work by The ArtGraTech does not imply that The ArtGraTech owns third-party trademarks or other intellectual property incorporated into that work.

Portfolio-display rights for commissioned projects are governed by the applicable project agreement and The ArtGraTech's Terms & Conditions.

9. THIRD-PARTY TRADEMARKS

Company names, product names, logos, trademarks, service marks, and other third-party identifiers appearing on the Site belong to their respective owners.

Reference to a third party does not necessarily imply:

  • endorsement by the third party;

  • sponsorship;

  • partnership;

  • affiliation; or

  • approval

unless expressly stated.

10. UNAUTHORIZED USE OF ARTGRATECH CONTENT

The ArtGraTech reserves the right to take appropriate action concerning unauthorized use of its protected content.

This may include addressing unauthorized:

Nothing in this Legal Notice grants permission to use ArtGraTech artwork or proprietary creative content to falsely represent authorship, create unauthorized commercial reproductions, or market derivative products as approved or created by The ArtGraTech.

Any rights that cannot lawfully be restricted remain unaffected.

16. NO IMPLIED LICENSE

Except for the limited personal-use permission expressly stated in this Legal Notice, nothing contained on TheArtGraTech.com should be interpreted as granting—by implication, estoppel, or otherwise—a license to use intellectual property owned by or licensed to The ArtGraTech.
